China plans to revise laws to strengthen the management of medical waste during major infectious disease outbreaks

      The draft amendment to the Law on the Prevention and Control of Solid Waste Pollution was submitted for deliberation at the 17th meeting of the Standing Committee of the 13th National People's Congress on the 26th. The draft amendment strengthens the management of medical waste, especially in response to major infectious disease outbreaks.
 
  Currently, in the fight against the COVID-19 epidemic, timely disposal of medical waste is a crucial step. Some members of the Standing Committee, NPC deputies, departments, localities and the public suggested that, based on the experience gained, more targeted provisions on medical waste should be made. The third draft amendment clarifies that medical waste should be managed in accordance with the national hazardous waste list. County-level and above local people's governments should strengthen the capacity building for centralized disposal of medical waste.
 
  The draft amendment clarifies the supervisory responsibilities.HealthThe competent departments of the county-level and above people's governments, such as health, ecological environment, etc., should strengthen the supervision and management of the collection, storage, transportation, and disposal of medical waste within their respective responsibilities to prevent harm to public health and environmental pollution.
 
  In terms of primary responsibility, the draft amendment stipulates that medical and healthcare institutions should collect and classify their medical waste in accordance with the law and entrust it to a medical waste disposal unit for disposal. The medical waste disposal unit shall promptly collect, transport, and dispose of the medical waste. Medical and healthcare institutions and medical waste disposal units shall take effective measures to prevent the loss, leakage, and spread of medical waste.
 
  Meanwhile, the draft amendment stipulates that during major infectious disease outbreaks or other emergencies, the county-level and above people's governments should coordinate the collection, storage, transportation, and disposal of medical waste and other hazardous waste, ensuring the necessary vehicles, sites, disposal facilities and protective materials.
 
  Furthermore, the draft amendment proposes that all levels of people's governments should allocate necessary funds for the emergency disposal of medical waste and other hazardous waste generated during major infectious disease outbreaks or other emergencies, according to the principle of division of powers.
 
  It is reported that the third draft amendment also provides regulations on integrated urban-rural life garbage classification management, prevention and control of construction waste pollution and resource utilization, reduction and recycling of packaging materials, and strengthening of laboratory solid waste management.
